As we discussed in a Opponents in court note that Congress declined to pass a cap-and-trade program, but the Supreme Court has made clear that courts should consider only laws Congress passed, not ones it didn’t. Congress could limit the E.P.A.’s existing authority, but it must pass new legislation to do so. Tellingly, Congress has considered proposals to do that, and none have passed. The law on the books is the Clean Air Act, and the Clean Power Plan is completely consistent with that bedrock law. EDWARD J.
