Restrictions in some states on access to DNA rape kits or the preservation of DNA forensic evidence place an unfair hardship on rape victims, who are largely women, not placed on other classes of crime victims. Victims of pay inequity and pregnancy discrimination too often lose their battles for justice. Federal courts should not be able to judge women’s rights by a lower standard of review because discrimination against women has not been deemed worthy of strict scrutiny, the higher standard of review afforded other forms of discrimination by the federal courts.
